Mediation

We may refer you and your partner to a trained Mediator to facilitate an agreement in respect of all issues arising from the breakdown of your relationship or in respect of specific issues such as the arrangements for your children.

Mediators are trained to help people resolve disputes. The Mediator will arrange to meet you and your partner and identify the issues that can and cannot be agreed. Mediators are neutral and will not take sides. They are not advisors and will not give advice to either you or your partner. Throughout the process, you are able to obtain legal advice from your own individual solicitors. During the process, when discussing finances, you and your partner will be expected to provide full disclosure of your financial information.

The objective is to try to reach an agreement in relation to all issues. If an agreement can be reached the Mediator will prepare a summary of the agreement. You will be expected to show the agreement to your individual solicitor for specific advice and, if it is agreed, to prepare a legally binding document to implement the terms of the agreement.

An agreement reached during mediation is not legally binding, which means that either one of you can change the terms of the agreement following legal advice.
